The office of the Controller General of Patents Designs and Trademarks has issued two public notices on 9th January in order to set right the procedural irregularities habited by the applicants and agents.
The first public notice relates to payment of statutory fees for expedited legal certificate. The Trademark office has been receiving the fees through checks most of which have reportedly returned for insufficiency of funds thereby causing inconvenience in the process. The notice makes it mandatory to pay statutory fees through Demand Drafts along with applications for expedited legal certificate (TM-70) and request for expedited certificate for copyright purpose under Rule 24(3) (TM-72).
The second public notice relates to irregularities in the trademark applications received by the Trademark office. Through the notice the applicants and agents are informed that the terms like "all goods/ services", "etc", "all other goods/ services included in class " , "goods/services not limited to " and so on in the goods/service description shall not be entertained. The notice also contains instructions on providing other details in the application.
