Delhi HC grants Ex-Parte Injunction in a Patent Suit by Vifor Int.

A single Judge bench of the High Court of Delhi has recently, in an interim application, granted an ex-parte interim order in favour of Vifor International granting injunction, against the defendants symedlabs. The order injuncts the defendants from selling and offering for sale the impugned drug iron carboxymaltose also known as ferric carboxymaltose which is allegedly infringing the Plaintiff’s patent (221536) on ‘novel water-soluble iron carbohydrate complex and a process for preparing the same’. The hearing for the original suit is scheduled on 15th December 2012.
