Dr Reddy’s appeals court decision on Treximet.

Dr. Reddy’s, Par Pharmaceutical and Alphapharm have filed an appeal to the U.S. Court of Appeals for the Federal Circuit on a lower court decision over Treximet. The lower court had upheld Treximet’s patents US6060499, US6586458 and US7332183 as valid and enforceable. Earlier, these companies had filed ANDAs seeking approval to market the generic forms of Treximet. Treximet’s patents are due to face expiration in 2017 (`499 and `458) and 2025 (`183).

Treximet having the active ingredients Sumatriptan and Naproxen Sodium, is a drug for the treatment of Migraine. Treximet, developed by Pozen, received marketing approval in 2008 and is marketed by Pozen’s exclusive US Licensee Glaxo Smithkline.
