Looks like the home grown conglomerate TATA has made its place in the branding industry in India. The Delhi High Court in a recent decision held that it is difficult to dispute the well knowness of the trademark “TATA” as far as India is concerned.The court's direction came over a petition filed by Tata Sons, against Durga Scale Company, asking the court to restrain Durga from manufacturing, selling and directly or indirectly dealing in goods bearing the trademark A-ONE TATA. Durga Scale Company is engaged in manufacturing weighting scales and springing balances under the trademark A-ONE TATA. Deciding over the matter, the Delhi High Court has imposed a fine of Rs. Two lakhs as punitive damages and restrained the defendant from using the trademark TATA.
