Gilead and Roche sue Natco over U.S. Patent for Tamiflu

Gilead Sciences, a California based bio-pharmaceutical research company along with another leading pharma company Roche has sued the Indian generic drug maker Natco Pharma. The suit was filed alleging that Natco had infringed Gilead’s  US patent for Tamiflu, Tamiflu is a drug used in treatment of bird and swine-flu infections. Tamiflu was developed by Gilead and it receives royalties on the drug’s sale from Roche.

In February, 2011, Natco had filed an abbreviated new drug application with the US Food and Drug Administration under Para-IV and alleged that Gilead’s patent on the drug was invalid and sent a notice to Gilead to that extent. But Gilead claims that its patent is valid and that any activities by NATCO with respect to the drug would amount to patent infringement. The suit has been filed in a federal court in Wilmington, Delaware to block generic versions of Tamiflu until its patent expires in 2017.
