Intellectual Property India is under going an infrastructure facelift as part of its recent efforts to clear the backlogs. In December 2010, the patent office started a backlog clearance drive under which the officials are working extra time including holidays to ensure that all pending patent applications are duly disposed off. In a similar move, as an effort to prevent a potential ‘docket explosion’ the Trade Marks Registry has centralised the system of printing and despatch of certificates at Trade Mark Registry, Mumbai.
According to a public notice dated 5th January 2011 issued by the Controller General, there are about 75000 applications pending trademark registrations and issuance of certificates. Under the centralised system, the Trade Marks Registry has stationed a fool proof electronic printing and despatch facility for Trademark certificates and the facility is operating under the direct supervision of the Senior Joint Registrar of Trade Marks. The registry equipped with the new electronic system is printing and despatching about 1000-1200 certificates every day and on a priority basis in accordance with the date of issue of journal publication. The system is expected to clear the back logs by the end of March 2011.
This move comes in the wake of implementations of the mandates of Madrid Protocol which is on cards, and enables the registry to comply with the time limitations mandated therein.
