US Supreme Court rejects Tiffany’s Trademark appeal


The U.S. Supreme Court on 29th November 2010 has not allowed the appeal of Tiffany & Co. in the trade mark case against eBay. The appeal relates to the  dispute of  eBay’s liability for trademark infringement for selling counterfeit goods on its website. Tiffany had instituted a suit against eBay in 2004 before the U.S. District Court for the Southern District of New York. Judge Richard J. Sullivan had concluded in the case that eBay, the proprietor of a website through which counterfeit Tiffany merchandise was sold, engaged neither in trademark infringement nor trademark dilution. This judgment was affirmed on appeal by the U.S. Court of Appeals for the Second Circuit and the appeal to the US Supreme Court has not been allowed.
