Gufic Biosciences, the Mumbai based company won a trademark infringement suit against the US based Estee lauder for its trademark. Estee Lauder had filed a trademark infringement suit against Gufic Biosciences to prevent it from selling their skin care product SKINCLINIQ STRETCH NIL under the latter’s ‘Cliniq’ brands. The Supreme Court Bench comprising of Hon’ble Justice B. Sudershan Reddy and Hon’ble Justice Surinder Singh Nijjar dismissed a special leave petition filed by Estee Lauder arm CLINIQUE Laboratories challenging the verdict of the Delhi High Court in April 2009, which went in favour of Gufic Biosciences Ltd. Dismissing the petition the Supreme Court held that the Gufic product, which is used to treat stretch marks associated with pregnancy was substantially different from the Estee Lauder product.
