Mumbai based company wins trademark case against Estee Lauder

Gufic Biosciences, a Mumbai based pharma company has won the trademark infringement case before the Supreme court. Estee Lauder arm Clinique, the world famous US based pharma company had sued Gufic Biosciences over its product stretch nil. Arm Clinique had filed a suit in Delhi High Court restraining the Mumbai based company from using the brand name stretch nil alleging that the brand stretch nil belonged to them. A single bench of the Delhi High Court on December 16, 2008, had restrained Gufic from using the brand, but a higher bench of the same court ruled in its favour in April, 2009. Therafter Estee lauder filed a special leave petition before the Supreme Court, but now the Supreme Court has dismissed the petition upholding the Delhi High Court’s decision.
