Local Hotel makes life difficult for Hilton International

In a rather surprising turn of events a District Court of Sirohi (Rajasthan) restrained the Hilton Group of Hotels from using their mark Hilton for hospitality services due to the presence of a Hotel called Hilltone in Mount Abu. While delivering the judgment the Judge is supposed to have indicated that ‘Hilton’ is not allowed to continue the use of their mark as it is confusingly similar to ‘Hilltone’ and may mislead the public.
Hilton group of Hotels is one of the most prominent group of luxury hotels in the world. They have been in business for close to 90 years. On the other hand Hilltone is a hotel based out of Mount Abu in Rajasthan.
Due to the non availability of the order currently it is difficult to say anything regarding seniority among the marks. Nonetheless it will be an interesting case to follow.

Frankly, there’s nothing surprising if the local brand has done its homework right. As you know Google could not use Gmail in some markets in Europe for several years as a local company had reserved the Gmail mark and making use of it in the same category.
